Terms of Service

1. The Service

Sellua is a software tool that helps Etsy sellers create product listings, generate text and images, publish listings, analyze market data, and (on eligible plans) fulfill orders through connected third-party platforms such as Etsy and AliExpress. Sellua is a tool; it does not operate your shop, make selling decisions for you, or guarantee any particular outcome.

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract to use the Service. By using the Service you confirm that you meet these requirements.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@sellua.io if you suspect unauthorized use. You agree to provide accurate information and to keep it up to date.

4. Plans, Credits, and Billing

• Each plan includes a monthly allowance of credits consumed by certain actions. Credit costs per action are described in the Service. Unless your plan explicitly states that credits roll over, unused credits expire at the end of each billing cycle.

• Subscriptions renew automatically at the end of each billing period unless you cancel before renewal. You can cancel at any time from your account; cancellation takes effect at the end of the current paid period.

• Prices may change. We will give you reasonable notice of price changes before they apply to your next billing cycle.

• You are responsible for any applicable taxes.

• The Service is offered on subscription plans (e.g. Starter, Pro, Scale), billed monthly or annually through our payment processor, Stripe.

5. Refunds

Except where required by applicable law, subscription fees and purchased credits are non-refundable, including for partially used billing periods or unused credits. If you are a consumer in the EU/UK, you may have a statutory right of withdrawal; by starting to use the Service immediately, you may acknowledge and waive that right to the extent permitted by law.

6. Third-Party Platforms — Your Responsibilities

This section is essential. The Service connects to and acts on third-party platforms, including Etsy and AliExpress, on your behalf and at your direction.

You acknowledge and agree that:

• You are solely responsible for complying with the terms of service, seller policies, and rules of every platform you use through Sellua, including Etsy and AliExpress. These rules can change at any time and are outside our control.

• You understand that certain selling practices — including reselling mass-produced goods, dropshipping, and automated publishing — may violate the policies of platforms such as Etsy and may result in your listings being removed and your account being suspended, restricted, or permanently terminated by those platforms.

• Sellua does not review, verify, or guarantee that any listing, product, or action complies with the policies of Etsy, AliExpress, or any other platform. You are responsible for reviewing all content and actions before publishing or fulfilling.

• You authorize Sellua to access your connected accounts and perform the actions you initiate or configure (such as publishing listings or placing fulfillment orders). You are responsible for those actions as if you had performed them yourself.

• You assume all risk arising from the use of the Service on third-party platforms, including the risk of account suspension, termination, financial loss, withheld payouts, or removal of listings. Sellua is not liable for any such consequences.

7. Acceptable Use

You agree not to use the Service to:

• Violate any law or the rights of others.

• Infringe intellectual property, including by copying another seller's designs, images, branding, or listings in a way that infringes their rights.

• Sell prohibited, counterfeit, unsafe, or illegal goods.

• Engage in fraud, deceptive practices, or abuse of any platform or payment system.

• Attempt to reverse-engineer, resell, or circumvent the Service or its credit limits.

• Interfere with the operation, security, or integrity of the Service.

We may suspend or terminate accounts that violate this section.

8. AI-Generated Content

The Service uses AI to generate listing text, images, and other content. AI output may be inaccurate, generic, non-original, or unsuitable, and may resemble content generated for other users. You are responsible for reviewing, editing, and verifying all AI-generated content before using it, including ensuring you have the necessary rights to any images and that descriptions are accurate. You are responsible for the content you publish.

9. Intellectual Property

We own all rights in the Service, including its software, design, and trademarks. We grant you a limited, non-exclusive, non-transferable right to use the Service while your subscription is active. You retain ownership of the content you create or upload, and you grant us a limited license to process it solely to provide the Service.

10. No Affiliation with Etsy or AliExpress

Sellua is an independent tool. We are not affiliated with, endorsed by, sponsored by, or otherwise connected to Etsy, AliExpress, or any other platform. All trademarks belong to their respective owners. Your use of those platforms is governed by their own terms.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or that it will produce any particular result. We make no guarantee of sales, income, profit, rankings, or business outcomes. Any earnings examples or projections are illustrative and not a promise of results.

12. Limitation of Liability

To the maximum extent permitted by law:

• Sellua will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, including those arising from suspension or termination of your accounts on third-party platforms.

• Our total aggregate liability for any claim arising out of or relating to the Service will not exceed the amount you paid us in the three (3) months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Sellua and its operator from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your content or listings; (c) your violation of any third-party platform's rules; (d) your violation of these Terms or any law; or (e) any action taken on your connected accounts at your direction.

14. Suspension and Termination

You may stop using the Service and cancel at any time. We may suspend or terminate your access if you violate these Terms, misuse the Service, or create risk or legal exposure for us. Upon termination, your right to use the Service ends; sections that by their nature should survive (including Sections 6, 9, 11, 12, and 13) will survive.

15. Changes to the Service and Terms

We may modify or discontinue features at any time. We may update these Terms from time to time; if changes are material, we'll notify you by email or through the Service. Continued use after changes take effect constitutes acceptance.

16. Governing Law and Disputes

These Terms are governed by the laws of France, without regard to conflict-of-law rules. Any disputes will be subject to the exclusive jurisdiction of the competent courts of Lyon, France, except where mandatory consumer protection law grants you the right to bring proceedings in your own country of residence.
